The SM Entertainment vs Kris & Luhan battle is ever the rage amongst the topics currently trending in K-Pop, and the prolonged controversy doesn\'t appear as though it will simmer down any time soon. The former EXO-M members, having been part of the monolithic music label for nearly four years, is now seeking to terminate their contracts. The two artists are now pursuing other interests over in China, disregarding their obligations to SM. There is no love lost between the label and the artists, as the two parties continue to butt heads. 
allkpop office decided to voice their opinions on the issue (and play the devil\'s advocate) with alim17 taking SM\'s side and jubilantj supporting Kris and Luhan. Read on to discover what the two have to say on this ongoing controversy! Who do you agree with?

both are at fault? well because, luhan & kris left for health issues and slave treatment but instead getting check ups and getting better but there they are. and sm? you know it, they\'re shitting it all up. so both are at fault. that\'s what i think. so.
Well...There must be some kind of magic in Chinas air. I thought they were really/badly injured. But they are promoting well in China. -__- I like them and even to me its odd. I will stand with SM this time. Are they are talented? Yes. Would they be standing where they stand if it wasn\'t for EXO? No.
This is all business... Where you give and take. It\'s not like building up their image was free. No one forced them to sign their contracts either. Yes, the hours are long and the work is tough, but those are the requirements of the job. It´s not like they didn\'t know. I understand SM is not humanistic enough, I also don\'t get why are they so demanding with their artist. But companies are like that. If you have a job, then you probably know it already.
It pains me because their attitude makes it hard to support them. I really thought their injuries were serious and was genuinely worried for their health. Seeing them promote themselves so fast makes me feel like a fool for believing them. :C not cool.
lol even the piece speaking for SM is actually siding more with Kris an Luhan  from an ethical standpoint...
I\'m just going to honestly say it but I thin kall three are basically at fault. I love Luhan and Kris, they\'re like BAES! But still, the boys should have known not to do these solo promotions while in a middle of a lawsuit proceeding. I know all y\'all fans be like " How could you say that? It\'s SM being unfair! " or like " Kris and Luhan should\'ve known better since they have been in the industry for a long time. " Well like, you guys are wrong anyways. As an international fan, you may think I don\'t understand the situation going on due to the fact that yes, I don\'t know them. I don\'t now their life. Probably you guys are thinking, " Who do you thin you are to tell us we\'re wrong? " but I told you, I\'m just saying what I think and what I thin is that SM, Luhan, and Kris are all at fault.
What I observed throughout my years as a Kpop star is that the whole Kpop fandom s absolutely doubtfully insane. I mean, what could we do? People in this fandom world thinks that comments lie these or rants like these could actually do something. They think that doing this would actually get someone\'s attention. But when Kris left exo, everyone went completely insane. Accusing SM of being a bad company is okay but just all rampage saying they should die is just crossing that Mexican border over here. 
As we know, Asians are damn racist. That\'s exactly what SM is I guess. But like I said, I don\'t know Mr. Lee Sooman. I don\'t know how he runs his company. But it\'s  obvious from the recent departure of Kris and Luhan, he must\'ve treated them racial different. And yes, that\'s not fair. But still, simply knowing from Kris and Luhan that they were sick of that crap, we haven\'t even heard what SM had to say. And yes, it\'s fucking important for us to know their damn side of the story too. Even if it\'s so bullshit lie, that gives us a more opportunity to see that, yes, SM is actually racially discriminating the foreign members.
More to get straight to the point so I Could end this, Luhan and Kris should not have continued promotions in China because as SM said that they are still under SM and have not yet left yet meaning that they broke the rules of the contract. Though SM had treated them unequally to the others, SM had indeed broke the rules too. But the thing I never understood was that I heard fro dispatch that Luhan had only left to see family again. But why is he continuing to do all these solo activities himself? I never understood that.  Is simply stupid how they had not finished sorting this out after a few months have passed and now are being forced. 
I don\'t know what will happen,I personally don\'t care what will happen, but I was just getting a bit pissed off at the careless comments being left on here. Just my opinion, don\'t take it so seriously, don\'t have to agree with me either cause I don\'t care about What you have to say booboo to me for saying what could possibly be the truth anyways. 
I think it all comes down to two factors: 1) Whether Kris and Luhan breached any terms in their contracts, and 2) Any evidence suggesting that SM breached any terms in their contracts. Since past negotiations and mediation all fell apart, it can be said that Kris and Luhan are still under contract with SM. So if the guys did breach any terms in their contracts, then yes, SM can file a lawsuit against them (sorry, fans, but that\'s reality). On the other hand, if SM did breach any terms of their contracts (same argument made when Han Geng (SJ) filed a lawsuit), then Kris and Luhan can file a lawsuit against SM. In fact, if it is discovered that SM have no grounds for suing them in the first place, the boys can actually sue them back (though chances of that is very, very slim).
In the end, it all comes down to the terms and conditions of their contracts, so I\'m not taking any sides until things become clearer. As much as I\'d like Kris and Luhan to pursue their dreams on their own terms, things aren\'t looking very good for them. I\'m all for that whole "fight the power" attitude, but in court, the judge and jury will only look at the evidence, and SM, having been in the entertainment industry far longer than Kris and Luhan (heck, they practically built the idol industry), definitely has the upper hand here by knowing the rules of the game, and how to play it to their advantage.
On the bright side, I don\'t think neither side would want this to go to court, so if the boys are lucky, they might settle out of court. Hopefully, this will be a valuable lesson for Kris and Luhan to be smarter and more cautious the next time they sign with an agency. Also, hopefully this will be another valuable lesson for SM to evaluate their policies and make some much-needed changes.
A contract is a contract and the law is the law and they shouldn\'t be breaking either of those, I can understand why sm is angry. And they wouldn\'t be able to do shit if it wasn\'t for their past in exo that made them famous and now they\'re kinda just taking advantage of that and basically giving middlefingers up to sm and exo. Ofcourse if Kris had a severe heart problem and they didn\'t get him treatment and he had to leave because his life was in danger than that\'s a whole other thing, ofcourse I would support that ! It\'s just that now they\'re working in China like they\'re completely fine and that\'s why some people, I guess me too, can\'t support them. It feels kinda like they just used sm and exo to get famous and then moved on.
Are they supposed to starve? How does it make sense that anyone would think that they would just stop working altogether? It doesn\'t make sense that someone would stop working just because they ended a contract with someone. It\'s like quitting a job. 
mmm I don\'t think going to a few month hiatus to settle their issues would have made them starve :/
Well I am a bit with SM with this one even though I am an EXO-L. I feel like they could at least bear with it because they did spend many years in training to become what they\'ve become today. Even though there is this slave contract, they read it and signed it. I would prefer that they kept a bit low profile because seeing their activities in China, personally, I feel like it\'s not really helping them maintain their image of the victim of the slave contract. Not that it\'s bad what they are doing, they are doing what they want, but still I\'d prefer they\'d keep it low profile!
I was with Luhan and Kris but after I saw that they do a lot of promotions in China without waiting for their contract to be canceled, I think that they used SM to become famous. I\'m with SM this time.
A commercial contract can be unilateral terminated with a notification of the other part and paying damages acc. to the clause or court settlment, that doesn\'t mean you are not alowed to do whatever you want to do. Sueing a third part for doing business with one of the part of the fore contract is stupid, because you lose (int\'l laws). In that case SM just want to keep their image and intimidate the third part. SM just want revenge like a distressful woman left by her lover.

Do you guys know what a contract means? Have you ever signed one and then ended it? Always read the contract before signing it! Always! 
Poor Kris and Luhan, they are clearly the victims here but they are getting run over by the fans for the fact that their fame, status, and money was due to SM. Can I ask a question? So because your parents sired and birthed you, your saying that since you owe them your life, you should continue to allow them to bully you after you escaped the mental
and physical abuse? If you owe them money I say pay it, but if they ever mistreated you in any way, it should be up to your own good graces that they get payed back in full. They are the ones who took liberty with your life, they are the ones who drove you to exhaustion and drove you harder still, they are the ones who took a percentage of your hard earned cash, they are the one
WHO BROKE THE CONTRACT FIRST. Any legality they are trying to claim should fly out the window cause I know SM\'s game, they play this sneaky little game where they will disagree and disagree with anything you say in order to drag out the suit. They will sue for a pin dropping on their bloody floor even though the things they did, have done, and will do is enough to tear down that whole building. After what they did to Hangeng I can\'t believe there are still people supporting SM in any kind of way! Do you guys even know what they did to that poor boy? Probably not.
All SM has gotten for their grievances was a stock fall for a tiny period of time and a slap on the wrist by the fans. Because the lambs will
always continue drinking at the fountain if the decorations look pretty huh? I grudgingly admit that Kris and Luhan are in a tight situation but not for 1 second will I turn my back on them. I have a tight head on my shoulders so I know if I am being screwed around with, SM at this point, trying to look all innocent and justified, is a joke, a sad joke.
Whuuu? Who broke the contract first? Whoever "broke" the contract, they\'d have to prove that in court. Seeing as the courts are not deciding on this case as fast as they did on Hangeng\'s (which only took a full year + eventually Hangeng did a retraction to remove doubts of SM "being in bad faith"), there\'s probably no clear definitive proof against SM Entertainment to support Kris and Luhan\'s case. That they are being asked to settle should be giving KrisHan side some room to breathe. It\'s hard to win this one. You should compare this to parenthood. You don\'t willing sign a contract to enter your mother\'s womb.
@many_maiden Ahem, if the company does something outside of the contract then that means they broke the contract. Did you not see the crazy schedule that the group had? Or was I not seeing them waking up crazy early hours in the morning for music shows, tv program taping\'s, AND rehearsal\'s every day with little to no breaks? Did you know that Luhan was using an IV in-between promotions? Why else do you think EXO were so quiet when he left, because his body looked like a living corpse. The reason why Hangeng\'s case was so fast was because of the OVERWHELMING amount of evidence he had against SM, not because he had evidence. Kris and Luhan would not have broke free of the contract if they had nothing on SM, the reason and ONLY reason why this case is lasting so long is because SM is dragging it out. Like they always do, same thing they tried to do with Hangeng, same thing they did and still do to JYJ. No difference.
@Daraismylife you have to look at the bigger picture... they are pushed to the max because they are young and there is so much competition in kpop. COME ON expand that brain of yours. you expect money to fall because you had one successful debut? please dont ever run a business nor invest on anything.

@many_maiden I can only tell you what I know, I don\'t have the exact details of their contracts but I do now that if you if are to be paid this certain amount of money and it\'s not given to you, that\'s breaking the contract. I do know that if they work you till you faint or your body is so thin you can see the light shining through your arm, that is breaking several common laws. Luhan looked like a scarecrow at one point, it was so scary to see him like that. Like I said before, Luhan and Kris would not have went against SM if they didn\'t have anything, we\'ll just have to wait and see. Only if the court puts a boot in SM\'s ass to get them moving though.
@littohui EXO did not have a successful debut per say, they were criticized to the max when they first debuted and only really got popular after Growl, I can understand if they pushed themselves to gain relevance. But after they got famous, their popularity grew too massive too fast, and instead of a gradual run into things they were shoved this way and that. With the increase of demand so was the increase in payment to have EXO on their shows, SM was perfectly happy to have EXO scoop up every last penny. I get that, get your money when you can get it, but if your members come to you with pleas of rest, you have no right to tell them no. What did they do? Shove them right out there. They didn\'t give EXO proper security either, resulting in Kai getting a bad waist injury on one occasion. I know how money is made dear, you don\'t need to educate me on that, but I know something else too. Money made off the backs of tired workers is dirty money, and dirty money is not worth having in my opinion.
I\'m not trying to sound wise but I guess both sides were at fault. Should SM taken a really good care of their artists from the beginning, this would\'ve never happened. I don\'t see any Chinese members from other agencies run back to their home country and make a case (or maybe I just dont know). But honestly I don\'t support the way Kris and Luhan handle this problem. They should\'ve waited until the case is over to continue with their career. Guess that would caused them losing a lot of opportunities, but that\'s the consequences. Pity the rest of EXO members though. They were the ones that hurt the most.
During the process the contract is suspended that means the contract is not in force and Kris &Luhan can continue their career with anybody.
not sure how people can even stand on SME side... just alone Hangeng and JYJ issue is enough to hate this agency deep to the core. 
Whether you like it or not... both sides are at fault. SM lacked on management to monitor members closely and take action before shit got out of hand. Now, Kris and Luhan (KL). These guys are unprofessional, whether you like it or not. SM pushed you hard because guess what? You need to get as much fame as possible before new groups start popping out and you lose your popularity. By popularity, it doesn\'t mean winning awards... that crap doesn\'t give you money(let\'s face it you need to eat and keep up your expensive lifestyle) Don\'t give me that crap that they don\'t spend money.. have you seen the clothes they wear? those brands run from few hundreds to thousands. The more often they are active there is more spotlight for shows, commercials, movies, etc. That\'s where they money come from, so both company and artists can profit. However, they decide to leave the company after 3 years from debut lol they have no backbone. Injuries and health? Yes, everyone gets hurt and sick. Too much work? DUH, the korean market is much more smaller than the chinese market, what did you expect? You gotta work that extra to get more $$. EVERYONE knows that SM is LEGALLY RIGHT, ETHICALLY not so much. What\'s is the point of having contracts when they can be breached so easily? Even chinese companies know the rule and wont dare to OFFICIALLY SIGN them. Screw arbitration let the court decide!
It\'s really surprising how people are justifying slave contracts as just competition, because honestly I\'d like to see what you\'d all do if you were worked to the point of health issues and exhaustion. In my opinion Kris and Luhan did what was right. As for the popularity issue, it was well known Luhan was the most popular member in China and so Exo-M wouldn\'t have been as successful without him either, so one has to remember success works both ways. SM has a legal standing yes, but they need to get it over and done with quickly instead of dragging it out. Exo\'s current comeback has absolutely slayed there\'s no doubt about that and they\'re still taking in the money. It needs to be resolved quickly, because this is getting ridiculous now.
